Surprise Billing Legislation Good Faith Estimate Requirements

On December 2, 2022 the Department of Health and Human Services (HHS) announced that CMS will NOT yet be enforcing the Good Faith Estimate requirements for uninsured self-pay patients from co-providers and co-facilities beginning on January 1, 2023. Per clarification in the FAQ, the HHS explains that “compliance with this provision is likely not possible by January 1, 2023, given the complexities involved.”  As noted, the HHS is extending enforcement discretion, pending further rulemaking.  Providers and facilities can also expect a reasonable amount of time to comply with the new implementation date, once established.
